Terms of Service

Last updated: July 2026

1. Overview & Acceptance

Brackify, Inc. (“Brackify,” “we,” “us,” or “our”) provides competitive gaming tools, tournament management, social networking, and subscription services through our web and mobile applications. By creating an account, purchasing a subscription, or otherwise using any Brackify service, you agree to these Terms of Service as well as our Privacy Policy, User Agreement, and Disclaimer (collectively, the “Agreements”). If you do not agree, do not access or use Brackify.

2. Eligibility & Accounts

  • You must be at least 13 years old (16 in the EU/UK) or have parental consent where required by law.
  • You agree to provide accurate, current, and complete information when registering and to update it as needed.
  • You are responsible for all activity that occurs under your account, including safeguarding credentials.
  • We may reclaim usernames or display names that infringe rights, impersonate others, or violate our community guidelines.
  • Accounts may be suspended or terminated for misuse, fraud, or violation of the Agreements.

3. Subscription Plans, Billing & Trials

Brackify offers free access and paid Plus/Pro tiers that unlock premium features such as advanced analytics, integrations, monetization tools, and enhanced social publishing.

  • Billing cycles: Paid plans renew automatically at the interval shown at checkout until cancelled. Applicable taxes are calculated based on your billing address.
  • Trials: Promotional trials convert to paid plans automatically on the stated renewal date unless cancelled before the trial ends. You can cancel during the trial to avoid charges.
  • No refunds: All subscription payments are final. We do not issue refunds or credits for partially used periods. You may cancel at any time to prevent future renewals.
  • Marketplace purchases: If you subscribe via the Apple App Store or Google Play Store, those marketplaces process your payments and manage cancellations in accordance with their policies.
  • Plan changes: We may adjust pricing, included features, or promotional offers with at least 30 days’ notice. Continued use after the effective date constitutes acceptance of the updated plan.

4. Affiliate Creator Program

Brackify operates an Affiliate Creator Program that allows approved creators to earn commissions by sharing their unique referral code with their audience. Participation is subject to approval and the following terms:

  • Commission rate: Approved creators earn 30% of the net subscription payment on each qualifying charge made by a subscriber who used the creator's code at checkout.
  • Commission window: The commission window is 6 months from the date of the subscriber's first qualifying payment. Payments made after the window closes do not generate additional commissions for that subscriber.
  • Annual (yearly) plans, one-time attribution: When a subscriber purchases an annual plan, the creator receives a single commission credit for the upfront annual payment. Because the next renewal invoice occurs 12 months later, after the 6-month commission window has closed, the renewal charge does not generate a second commission. Creators earn one payment per annual subscriber.
  • Monthly plans: Creators earn a commission on each monthly renewal payment that falls within the 6-month window, up to a maximum of 6 monthly credits per subscriber.
  • Self-referrals: Creators may not use their own code to subscribe. Self-referrals are automatically blocked.
  • Minimum payout: Earned commissions accumulate in your creator balance. Payouts require a minimum balance of $50 and a connected Stripe Express account. Payouts are typically processed within 24 hours of request.
  • Commission basis: Commissions are calculated on net payment amounts, after any applicable Stripe platform fees or taxes that Brackify remits, and are not paid on refunded or chargebacked transactions.
  • Program changes and revocation: Brackify may modify commission rates, payout thresholds, or program terms with 30 days' notice. Creator access may be revoked immediately for fraud, spam, misrepresentation, or violation of these Terms.

Questions about the program can be directed to [email protected].

5. Acceptable Use & Community Standards

Brackify combines tournament infrastructure with social features. You agree to follow our Community Guidelines, tournament rules, and applicable laws when interacting with the platform.

  • No harassment, hate speech, defamation, or threats (including in private messages and message requests).
  • No spamming, phishing, scraping, reverse engineering, or automated data harvesting (including mass message requests).
  • Only upload content you have the right to share. You grant Brackify a worldwide, royalty-free license to host, display, and distribute it solely to operate and promote the service. For private messages, that license is limited to operating, securing, delivering, and moderating the messaging feature as described in our Privacy Policy.
  • We may remove content, suspend accounts, limit discovery, or notify authorities when necessary to protect the community.

6. Social Messaging (Direct Messages & Message Requests)

Brackify provides optional private messaging between accounts ("Social Messaging"), including mutual-follower direct messages, non-mutual message requests, conversation tools (mute, archive, block, report), and related notifications. By using Social Messaging you agree to this section, our Privacy Policy, and User Agreement.

  • How messaging works: Direct (open) messaging is available when both users follow each other. If you are not mutual followers, a first message may be delivered as a message request, subject to the recipient's privacy settings (for example: everyone, people they follow, or no one). Opening a profile compose screen alone does not create a request or notify another user; a request is created when a message is actually sent.
  • Not public by default: Message contents are intended for conversation participants. They are not published on public profiles, feeds, public search, or public analytics. Previews of notifications are generic (for example, "New message from username") and are not designed to expose full private message text. How message content is processed and secured is described in our Privacy Policy.
  • Your responsibilities: You are solely responsible for the content of messages you send. You must not use messaging for harassment, threats, hate speech, sexual content involving minors, scams, impersonation, spam, unlawful solicitation, or other prohibited conduct. You must not message users who have blocked you, attempt to evade blocks or safety tools, or use automation to mass-message accounts.
  • Safety tools: You may mute, archive, block, soft-delete for yourself, report conversations or messages, and manage message-request and notification preferences. Blocking or declining a request is intended to stop further messaging under our product rules. Reports may be reviewed by Brackify for safety and policy enforcement.
  • No guarantee of absolute privacy: While Social Messaging is private between participants by product design, Brackify may access, review, retain, or disclose message content when reasonably necessary to: (a) operate and deliver the feature; (b) investigate reports, abuse, fraud, or security incidents; (c) enforce our Agreements; (d) protect the rights, safety, or property of users or others; or (e) comply with law, legal process, or governmental requests. We do not guarantee that messages will remain confidential under all circumstances, including device compromise, account takeover, or legal compulsion.
  • Moderation and enforcement: We may limit messaging, throttle requests, remove or restrict content, and suspend or terminate accounts that abuse Social Messaging. Automated systems (for example, rate limits and spam detection) may block or delay messages. Enforcement decisions are made at our discretion consistent with applicable law.
  • User content liability: Brackify is a platform for user-generated communications. Except as required by law, we are not responsible for messages sent by users. You agree that interactions with other users, including private messages, are at your own risk. If you believe a message violates the law or our policies, use in-app reporting and, where appropriate, contact law enforcement. For product safety reports, use in-app tools or email [email protected]. For emergencies or imminent harm, contact local emergency services first.
  • Minors and age-restricted content: You must meet the age requirements in Section 2. You must not use messaging to exploit, solicit, or endanger minors, or to send sexual content involving anyone under 18. We may remove content and take enforcement action without prior notice when child safety is at risk.
  • Data and retention: Message content, metadata (participants, timestamps, read status, report status), and moderation records are processed as described in our Privacy Policy. Soft-deleted messages or conversations may remain stored for a period needed for safety, legal, or operational purposes.

7. Tournament & Organizer Responsibilities

Event organizers control their tournaments and must publish accurate rules, schedules, eligibility criteria, and prizes. Paid organizers agree to Brackify's standard Tournament Payments & Prize Pots Policy. Organizers are solely responsible for compliance with promotion, gambling, tax, consumer-protection, licensing, and other applicable laws.

For paid tournaments, the organizer is the seller. Brackify provides the platform and payment workflow, while PayPal processes payments for the organizer through their connected PayPal business account. Organizers are responsible for delivering the event, handling eligible refunds under the standard policy, paying prizes and winners, and resolving participant questions. Entry and venue fees do not become prize money unless the organizer expressly states that in the tournament rules. Prize-pot contributions are optional and may not grant a competitive advantage.

The Tournament Payments & Prize Pots Policy forms part of these Terms and explains price disclosures, Brackify service fees, refunds, disputes, prize-pot accounting, and organizer obligations. Participants must review it before creating a paid checkout. Brackify may suspend payment access, reject transactions, or require additional information where necessary to prevent fraud, comply with PayPal requirements, or protect users.

If you enable optional integrations (e.g., Twitch, Discord, streaming overlays), you must secure permissions from participants and third-party platforms and comply with their terms.

8. Mobile Apps, Third Parties & Stores

Brackify relies on services including PayPal, Stripe, Firebase, Cloudinary, Twitch, Discord, Apple, Google, and other cloud providers. Each service is governed by its own terms. We are not responsible for outages or changes introduced by those partners.

When downloading our iOS or Android apps, you acknowledge that Apple and Google are not parties to these Terms, do not provide support, and are not liable for claims relating to Brackify. You must comply with the App Store and Google Play policies at all times.

9. Intellectual Property

Brackify, our logos, code, designs, and platform features are protected by intellectual property laws. Except for your personal right to use the services, no licenses are granted. Third-party names and assets belong to their respective owners and do not imply endorsement.

10. Disclaimers

The services are provided “as is” and “as available.” We do not guarantee uninterrupted access; accurate listings; error-free brackets, analytics, notifications, or messaging delivery; or compatibility with every device or network. Tournament outcomes, community content, private messages between users, and recommendations are not guaranteed and may rely on third-party information or user-generated content.

11. Limitation of Liability

To the maximum extent permitted by law, Brackify and our directors, officers, employees, agents, partners, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption arising from or related to your use of the services, including disputes or harm arising from user-to-user messages.

Our aggregate liability for direct damages will not exceed the amounts you paid to Brackify for the services in the six months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Brackify, its affiliates, and personnel from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including attorneys’ fees) arising from your tournaments, content, messages, use of the services, breach of these Terms, or violation of any law or third-party right.

13. Changes, Suspension & Termination

We may update these Terms at any time. A new “Last updated” date will appear at the top, and we will provide additional notice for material changes as required by law. Continued use after the effective date constitutes acceptance.

We may suspend or terminate access to any feature or account for violations, security reasons, inactivity, or legal obligations. You may close your account at any time; some information may persist as allowed by law and described in our Privacy Policy.

14. Governing Law & Contact

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the state or federal courts located in Wilmington, Delaware, unless applicable law mandates a different forum.

If you have questions or need to exercise legal rights, contact us at [email protected]. Thank you for your cooperation and understanding.
